Program Terms: We recommend that you carefully go through the TRH program to better understand the different features of our service. By subscribing to the registration process at The Reading Habit (TRH), Members accept all items in the Terms of Use and agree to abide by and be legally bound by the Terms of Use.

1 .

Eligibility

Any individual who submits a fully complete application form for membership with a) address of residence / work b) mobile phone number & billing address and c) communicable email address is welcome to sign up with TRH. However, TRH reserves the right to accept or reject membership at its sole discretion. Membership is for personal use only. No member may re-lend books borrowed from TRH at any time. Doing so will entail automatic cancellation of membership

Plans & Payment terms

By subscribing to a specific membership plan of TRH, the member is explicitly agreeing to pay, in advance, the reading/ subscription fee attached to the plan plus and any other applicable fee at the frequency specified by the plan.

Reading period and reading fee

TRH allows a reasonable reading period to all its members under valid subscription. However, under specific circumstances where other library members have requested for and are waiting for a book/s and the member holding the book have the book issued in their account for more than sixty (60) days, TRH reserves the right to contact and request members holding book/s to be returned. Members are requested to then return the requested book/s within ten (10) working days of such request. Reading/ subscription fees should be paid as per the plan. In the event a member does not renew his/her subscription TRH reserves the right to adjust the deposit amount towards the reading/ subscription fees. If there is no balance in the Deposit Amount, then the company will terminate the membership of the member. All correspondence in this regard will be communicated to the registered Whatsapp number &/or email address of the member as submitted at the time of registration. Members are requested to update their contact details periodically when changed. Subscription fee paid in advance will not be refunded. Monthly charges will continue to be applicable in case books are not returned and the same will be deducted from the security deposit.

Lost or Damaged books

At TRH, we take utmost care to maintain books in good condition. Any anomaly (unprinted pages) or damage if found should be reported to +91 77386 32484 within 24 hours of receiving the books in Home Delivery option. Failure to check and/or report the same will be constituted as if the member has received a book in good condition. While returning the book, TRH will check for any damage of book(s) and report to the member accordingly. The determination of a book being “damaged” will be at the sole discretion of TRH. Members can choose to replace a lost or damaged book within 10 days or pay the penalty amount determined by TRH. The damage policy is detailed below.

Membership closure & refund of deposit

Members who wish to close their subscription can submit the request by contacting +91 77386 32484. Membership closure will be processed after checking for due fees, lost books and the refund of deposit will be processed within 7 working days from receiving the request.

Unclaimed Refundable Deposit

Upon expiry of membership, TRH sends reminders over emails/sms/ Whatsapp to its members for renewal. Three months after expiry, TRH reserves the right to classify the account as ‘Dormant’ and initiate steps to recover cost of books and any unpaid reading fee from the refundable deposit, if there is no action on the reminders, which would be communicated to the member through email/sms/ whatsapp. Post this recovery, any excess deposit left in the account will be retained as “Unclaimed” refundable deposit for a period of 3 months and periodic reminders would be sent to the member to claim the same. After 12 months of expiry of membership, TRH reserves the right to treat the member as “not reachable” and take appropriate action on the unclaimed refundable deposit if there has been no response from the member on the reminder communications.

Definition of a BOOK

Since the reading fee is a flat rate and is not linked to the number of books read in a period, it is important to note that each title catalogued in TRH gets the same treatments irrespective of size, cost & target reader. Children’s books are treated the same way as other books.

8.

Changes to Terms of Use

TRH reserves the right, from time to time, with or without notice, to change these Terms of Use in its sole and absolute discretion. The most current version of these Terms of Use can be reviewed by clicking on the “Terms of Use” located at the bottom of the pages of the www.thereadinghabit.com website. The most current version of the Terms of Use will supercede all previous versions. Your continued use of our service after changes are made means that you agree to be bound by such changes.

The ‘Terms of Use’ of TRH is critical in its continuous efforts to offer a unique reading experience to members. Please read the conditions & stipulations set forth in this document, We look forward to your co-operation in adhering to the same. Thank you for your membership. The User unilaterally agree to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of www.thereadinghabit.in or their breach of the terms.

Liability

(a) User agrees that neither Company nor its group companies, directors, officers or employee shall be liable for any direct or/and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from un-authorized access to or/and alteration of user’s transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages (b) User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent. (c) User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company’s total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.

Disclaimer of Consequential Damages

In no event shall Company or any parties, organisations or entities associated with the corporate brand name us or otherwise, mentioned at www.thereadinghabit.in be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organization or entities were advised of the possibility of such damages.
